Summary: The present study aims to understand the exercise of social control that the Prosecutor Department (Ministério Público) exerts in assuring children and adolescents rights concerned to communitarian and familiar conviviality. To that purpose, it was acted out a bibliographical research all the way from the short historical study from the child and adolescent situation, to the arrival of the Portuguese people in Brazil, until nowadays, showing that the changes in the way we understand the child created several changes in Brazilian Laws, from the irregular situation’s doctrine to the full protection’s doctrine and, as a consequence, changes in the public politics related to the children and adolescents servicing; debate exhibition about the social control as a mechanism of popular participation in elaborating and implementing public politics; Prosecutor Department historical study and its relationship to the 1988 Federal Constitution and the Prosecutor acting, highlighting the challenges that need to be overcame, the gains already reached and the important role that that institution possesses in assuring protection to children and adolescents in Brazil; Case study developed in Vitória’s Childhood and Youth Prosecutor Department to get to know the exercise of the social control assuring the rights to communitarian and familiar conviviality and; interview with Vitória’s Childhood and Youth Prosecutor and with Vitória’s tutelary council.
